§ 1 Subject of the business conditions

Subject of the general business conditions is the settlement of the terms for all agreements between Arthur-Queue & Billard-Dienst (contractor) and the user of the online shop (user), that are concluded over the Arthur-Queue & Billard-Dienst online shop.

§ 2 Proposal

Our proposal is always without engagement and non-binding. Technical and creative variances of the information and pictures in the catalog or in our internet shop stay reserved. We are not liable for misprints or permanent delivery capacity of the products. The appropriate general business conditions are valid to the time the contract is completed.

§ 3 Order

Order of products are accepted verbally (by phone) and in written form (facsimile, e-mail, letter). Personal data, that we need to save for processing and performance of your order,  are handled confidential. Cancellation must be taken in written form and can only be considered if the order hasn't yet been edited.

§ 4 Prices

All prices include the sales tax (currently 19%). All prices are calculated ex works (Frankenthal).

§ 5 Payment

We deliver by prepayment, cash on delivery, invoice (regular customers), bank debit memo or PayPal (by assignment or with credit card -Euro-/ Master-Card, VISA, etc.) For buyers in collection procedure debt collection routine, shipment is only possible by prepayment.  By default of payment we charge interest of 5% of the bankrate of the German Central Bank. Therefor no certification drawdown of a credit is needed. At payment method debit advice/nvoice/credit card we reserve our right to obtain a status report.

§ 6 Delivery

Subject to the instant availability of the products, we deliver as soon as possible by DPD, post or forwarding agency. We are not liable for the compliance of the appointed delivery time after the products have left our house. In case of non-acceptance or refusal we charge all incurred expenses. If the products are blemished or damaged we can either deliver replacement or repair. Possible costs or indemnity claim of the buyer are barred.

§ 7 Purchase tax

All prices contain the legal purchase tax.

§ 8 Title retention

Till full payment the products stay in our property and it is not allowed to resell or transfer them. All delivered products are signed our property explicit under express enchanced and exteded property exception.

§ 9 Subject of change

The products are displayed exemplary in the internet shop by pictures. The products can depart from the shown pictures. The bidder reserves the right to make changes for advancement and improvement of the products, also for the change of color. The bidder has the right to deliver the modified products. If the ordered product is not available, the vendor has the right not to send the products.

§ 10 Warranty

The legal warranty average is 2 years and starts with delivery of the goods. Obvious defects are to be complained directly to the deliverer of DPD.  During the time of warranty we reserve our right to repair at no charge. We are not liable for defects by faulty usage or external induction. During this time all lacks that succumb to the legal warranty are fixed at no charge. Your warranty rights are firstly bounded to supplementary performance. You have the right for abatement of the purchase price or rescission of the contract , if the supplementary performance is not fulfilled.  Hereof excluded are damages that are caused by natural abrasion , by improper use and lacking or wrong care.

The goods must be sent back undamaged, idle and in the original packing.

§ 12 Return

You can send the goods back without  giving reasons within 2 weeks after giving the order.
The deadline begins with the validity of the contract.
To observe the deadline it is adequate to send the products in time.
From an merchandise value of  40,00 € incl. sales tax, the return falls to our expense.

§ 13 Return follow-up

In case of effective exercise of the warranty, the services of both sides are to be granted and indicated term compensations for use (like advantage of use) are to be edited.
At a degradation of the products a compensation of value can be charged.
This does not apply, if the degradation of the goods exclusively is only possible after receiving the products back.
Incidentally  you can avoid compensation of value by not using the product and take no actions, which affect the value.
If you make use of the return, the contract gets invalid.

§ 14 Legal venue, place of fulfilment

Provided that no opposition against the egal arrangements are present, Frankenthal is essential for traders and foreigners. For private persons the appropriate court counts. German Law counts under exclusion of the UN-Convention of Contract. By ordering, the buyer accepts this assertively.

§ 15 Deviant customer terms

For the case that the customer uses own Gerneral Terms and Conditions, that disagree with of ours in substance, the AGB of the provider count.

§ 16 Severability Clausel

If some of the arrangements in the contract are invalid, the rest of the arrangements remain unaffected.

The here shown products and brands are property of the particular manufacturer and conduce only for identification of the single products.
